NOTICE OF REVISIONS FOR VOTE ON WHETHER SHORT TERM RENTERS SHOULD HAVE ACCESS TO LAKE ARROWHEAD
 

Based on feedback from the ALA membership, the upcoming vote on Short Term Renter access to Lake Arrowhead has been revised (see page 2) and will now begin on March 13, 2020.
 
Background
Some ALA members are currently renting their homes in Arrowhead Woods for less than a 30 day period (“Short Term Rentals”) through sites such as Airbnb, VRBO or by other means. Some Short Term Rentals inform their clients that they may use the ALA trails, beach clubs, Lake Arrowhead and other ALA amenities (“ALA Properties”) because they are in Arrowhead Woods.
 

The ALA Bylaws (“Bylaws”) currently do not state whether Short Term Renters can or can’t access ALA Properties. ALA’s Board of Directors wants to have a clear definition of whether the ALA membership wants to allow Short Term Renters to access ALA Properties. Accordingly, the ALA Board of Directors recently decided to conduct a vote by the ALA membership to determine whether Short Term Renters should be able to use ALA Properties.
 
The vote of the members will be by written ballot.  ALA will be sending this written ballot to all ALA members who were in good standing with ALA as of February 1, 2020 (the “record date”). At least 5% of the ALA members entitled to vote must cast ballots to establish a quorum.  If there are not enough votes cast to establish a quorum the Bylaws will not be amended by the vote. The ballot will have two questions which must be answered for the ballot to be counted.
 
Question 1
Members will be asked to vote on whether or not to amend the Bylaws to regulate Short Term Renter use of the ALA trails, beach clubs, Lake Arrowhead and other ALA Properties.
 
Voters will be asked to mark “X” in front of their vote as follows:

Voters must select Yes or NO in order to continue.
 
____ Vote YES if you want a new Bylaw to regulate the use of ALA Properties by Short Term Renters.

____ Vote NO if you do not want a new Bylaw to define regulations for Short Term Renter use of ALA Properties.
At least 51% of the votes cast for Question 1 must be in favor of amending the Bylaws (YES to question 1) to create a new Bylaw to control the use of ALA Properties by Short Term Renters. If 51% of the votes cast do not vote to amend the Bylaws (NO to Question 1), the Bylaws will not be amended by the vote.

Question 2
Regardless of whether you vote YES or NO for amending the Bylaws, you will then need to choose from the two proposed Bylaw amendments listed below. The proposed Bylaw amendment below that receives the most votes will be made part of the Bylaws if the result of Question 1 is to create a new Bylaw. Thereafter, the Bylaw can only be modified by a subsequent vote of the members.

____ PROPOSED BYLAW AMENDMENT - #1
Do NOT allow access
“ALA will NOT ALLOW any Short Term Renter to use the ALA trails, beach clubs, Lake Arrowhead, ALA parks, any dock or pier site. In addition, Short Term Renters cannot receive ALA boat operator licenses, use kayaks, paddle boards, boats, sail, fish or swim in Lake Arrowhead or Grass Valley Lake.”
 
____ PROPOSED BYLAW AMENDMENT - #2
Allow FULL access except no use of powerboats
“ALA will ALLOW Short Term Renters to use ALA trails, use beach clubs, fish and swim in Lake Arrowhead, use ALA parks, use the STR owner's dock/pier, receive ALA boat operator licenses, use kayaks and use paddle boards, so long as the ALA member renting to the Short Term Renter pays ALA a fee in an amount to be set by the ALA Board of Directors on an annual basis. The amount for the 2020 season (April 1, 2020 to March 31 2021) will be $1,000. Short Term Renters will NOT be allowed to use powerboats. All Short Term Renters must comply with all ALA Bylaws, Rules, Regulations and Policies.

Voting Instructions
In order for a member’s vote on the second question to be counted, the member MUST vote either YES or NO on the first question - whether the Bylaws should be amended - AND choose which proposed Bylaw amendment they want to be in the Bylaws if the Bylaws are amended.
 
Once voters have marked their ballot, they will place the ballot in the envelope provided (marked BALLOT RETURN ONLY) and mail the envelope, or bring the envelope containing the ballot to the ALA office during normal business hours where the ballot envelope can be deposited in a secure box.
Your ballot must be returned in the enclosed Ballot Envelope. 
 
Ballots will be mailed to ALA members prior to the vote. Voting will be open from March 13, 2020 at 8 AM through April 10, 2020 at 5 PM PST.  Any ballot received after 5 PM PST on April 10, 2020 will not be counted. Lake Arrowhead is, and has always been, a private lake.

Some Short Term Rentals inform their clients that they may use the ALA trails, beach clubs, Lake Arrowhead and other ALA amenities (“ALA Property”) because they are renting properties in Arrowhead Woods.
 
The ALA Bylaws (“Bylaws”) currently do not state whether Short Term Renters can or can’t access the ALA Property because they are renting properties in Arrowhead Woods.

At least 5% of the ALA members entitled to vote must cast ballots to establish a quorum.  If there are not enough votes cast to establish a quorum the Bylaws will not be amended by the vote.
 
The ballots will contain two questions both of which members must answer.

Question 1
Members must vote whether to amend the Bylaws to specifically regulate the use of the ALA trails, beach clubs, Lake Arrowhead and other ALA owned amenities by Short Term Renters.
 
Vote YES – if you want to limit or stop the use of ALA Property by Short Term Renters.
 
Vote NO – if you do not want a new Bylaw to define regulations for Short Term Renter use of ALA Property.
 
At least 51% of the votes cast must be in favor of amending the Bylaws (YES to question 1) to limit or stop the use of ALA Property by Short Term Renters. If 51% of the votes cast do not vote to amend the Bylaws, the Bylaws will not be amended by the vote.
 
Question 2
Regardless of whether the member votes YES or NO on amending the Bylaws, the member will be asked to choose from two proposed Bylaw amendments. The proposed Bylaw amendment that receives the highest percentage of the votes in the second question will be made part of the Bylaws if the result of Question 1 is to create a new Bylaw. Thereafter, the Bylaw can only be modified by a subsequent vote of the members.
 
The proposed Bylaw amendments to be on the ballot are as follows:
 
PROPOSED BYLAW AMENDMENT - #1
“ALA will not allow any Short Term Renter to use the ALA trails, beach clubs, Lake Arrowhead, ALA parks, any dock or pier site. In addition, Short Term Renters cannot receive ALA boat operator licenses, use kayaks, paddle boards, boats, sail, fish or swim in Lake Arrowhead or Grass Valley Lake.”
 
PROPOSED BYLAW AMENDMENT - #2
“ALA will allow Short Term Renters to use the ALA trails and beach clubs so long as the ALA member renting to the Short Term Renter pays ALA a fee in an amount to be set by the ALA Board of Directors on an annual basis. All Short Term Renters must comply with all ALA Bylaws, Rules, Regulations and Policies. Short Term Renters cannot access Lake Arrowhead, ALA parks, any dock or pier site or receive ALA boat operator licenses, use kayaks, paddle boards, boats, sail, fish or swim in Lake Arrowhead or Grass Valley Lake.”
 
Important Note

Voting will be open from February 27, 2020 at 8 AM through April 1, 2020 at 5 PM PST.  Any ballot received by ALA before 8 AM on February 27, 2020 or after 5 PM PST on April 1, 2020 will not be counted.
 
The above voting instructions will also be included in the ballot mailing for your reference.
 
ALA hopes all members will vote on this very important issue in our community.
